How to prepare EPR annual compliance report?

When preparing to file your annual EPR compliance report with the Central Pollution Control Board, there are several important factors to consider:

1. Check the EPR regulations: To ensure that you are submitting your annual EPR (Extended Producer Responsibility) return correctly, you should first determine which rule or regulation applies to your business. This will help you identify what needs to be submitted to the Central Pollution Control Board (CPCB) or the State Pollution Control Board (SPCB). For example, suppose you are an importer of plastic sheets falling under the Plastic Waste Management Rules, 2022. In that case, you must register yourself under the importer’s head and file your annual EPR compliance report accordingly. Therefore, checking the EPR regulations before submitting your annual EPR return is essential. 

2. Your EPR obligations: When you issue the EPR certificate, you have certain obligations to meet. These obligations are based on the amount of waste (such as plastic waste, E-waste, or battery waste) that is being released into the market. The CPCB or SPCB sets EPR targets according to this quantity. Your EPR obligations are determined by the amount of imported, produced, or branded products that you sell or purchase. To meet these obligations, you can either establish your own collection and recycling infrastructure or agree with a recycling agency approved by the CPCB/SPCBhave to purchase EPR credits from these recycling firms to fulfill your targets.

3. Collection of EPR data: Collection and arrangement of the necessary data in the form of sale and purchase bills of the specific product, Pre-consumer and post-consumer data, and processed product data are required. To set off the EPR liability imposed upon a producer, importer, or brand owner, it is essential to purchase the EPR certificates.

4. Prepare your EPR submission report: To comply with EPR regulations, follow these steps. First, import the collected data into the online EPR portal of CPCB, according to the specific format provided by CPCB. Then, receive the EPR credits from an approved recycling agency. In addition, you should provide specific company information, product details and quantities, EPR targets achieved, methods of achieving targets, and expenses incurred on EPR compliance. 

5. Submission of the CPCB report and pay EPR fees: Please ensure to submit your annual EPR report by the deadline, which is typically June 30th after the financial year, through the CPCB EPR portal. If you fail to submit your EPR compliance report on time or do not fulfill your EPR targets, you may be subject to environmental compensation (EC).
